1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement between you (the "Client") and Whispervale (the "Provider," "we," "us," or "our") governing your use of our Thai bodywork services, website, and related offerings.

By booking a session, using our website, or engaging with our services in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with these terms, please do not use our services.

2. Definitions

For purposes of these Terms:

  • "Services" refers to all Thai bodywork sessions, consultations, and related offerings provided by Whispervale
  • "Client" or "You" refers to any individual who books or receives our services
  • "Session" refers to a scheduled appointment for Thai bodywork
  • "Practitioner" refers to the trained professional providing bodywork services
  • "Website" refers to our online presence at whispervales.pro

3. Eligibility and Capacity

To use our services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding agreements
  • Provide accurate information when booking sessions
  • Disclose any health conditions that may affect the safety or appropriateness of bodywork

Individuals under 18 may receive services only with explicit parental or guardian consent and presence during the session.

4. Service Description

Whispervale provides traditional Thai bodywork services including:

  • Traditional Thai Bodywork sessions (60-90 minutes)
  • Signature Wellness Journey sessions (120-150 minutes)
  • In-Room Private Sessions (60-120 minutes, mobile service)

Sessions combine rhythmic compression, assisted stretching, and pressure point work adapted to individual needs. We reserve the right to modify service offerings, session formats, or techniques without prior notice, though such changes will not affect already-scheduled appointments.

5. Booking and Scheduling

5.1 Making Appointments

Sessions may be booked by phone or through our website contact form. We will confirm your appointment via email or phone. An appointment is not finalized until you receive confirmation from us.

5.2 Cancellations and Rescheduling

  • Cancellations must be made at least 24 hours before your scheduled appointment
  • Late cancellations (less than 24 hours notice) may result in a 50% session fee
  • No-shows will be charged the full session fee
  • Rescheduling is subject to availability and must be done at least 12 hours in advance

5.3 Late Arrivals

If you arrive late for your appointment, the session will end at the originally scheduled time. We cannot extend sessions beyond their allotted time to accommodate late arrivals, as this would affect subsequent clients.

6. Payment Terms

6.1 Pricing

Current session prices are:

  • Traditional Thai Bodywork: TWD 2,000
  • Signature Wellness Journey: TWD 4,500
  • In-Room Private Session: TWD 11,000

Prices are listed in Taiwan dollars (TWD) and are subject to change with reasonable notice. Price changes do not affect already-booked sessions.

6.2 Payment Methods

We accept payment by:

  • Cash
  • Bank transfer (details provided upon booking)

Payment is due at the time of service. For in-room sessions, payment is collected upon completion of the session.

6.3 Refund Policy

Refunds are provided only for cancellations made at least 24 hours in advance. Late cancellations and no-shows are not eligible for refunds. In cases of practitioner cancellation or rescheduling, full refunds or complimentary rescheduling will be offered.

7. Health and Safety

7.1 Health Disclosures

You are required to disclose any health conditions, injuries, or medical concerns that may affect the safety or appropriateness of bodywork. This includes but is not limited to:

  • Recent surgeries or injuries
  • Chronic health conditions
  • Pregnancy
  • Cardiovascular conditions
  • Skin conditions or sensitivities

Failure to disclose relevant health information may result in session termination without refund.

7.2 Medical Clearance

For certain conditions, we may require written clearance from your healthcare provider before providing services. This is for your safety and ours.

7.3 Contraindications

We reserve the right to refuse or modify services if we determine that bodywork may be contraindicated for your current health status.

8. Client Responsibilities

As a client, you agree to:

  • Arrive on time for scheduled appointments
  • Provide accurate health and contact information
  • Communicate clearly about pressure, comfort, and any concerns during sessions
  • Respect practitioner boundaries and maintain appropriate conduct
  • Follow pre- and post-session recommendations (e.g., hydration, avoiding heavy meals)
  • Inform us immediately if you experience adverse reactions following a session

9. Scope of Practice and Limitations

Thai bodywork as provided by Whispervale is:

  • A wellness practice focused on tension release, flexibility, and relaxation
  • Not a substitute for medical diagnosis, treatment, or professional healthcare
  • Not intended to diagnose, cure, or treat medical conditions
  • Complementary to, not a replacement for, conventional medical care

We are not licensed medical professionals. If you have medical concerns, consult a qualified healthcare provider.

10. Professional Conduct

Whispervale maintains strict professional standards:

  • All sessions are conducted with respect for client dignity and boundaries
  • Draping and appropriate attire are maintained at all times
  • No sexual or inappropriate conduct will be tolerated from clients or practitioners
  • Clients exhibiting inappropriate behavior will be asked to leave immediately without refund
  • We reserve the right to refuse service to anyone who violates professional boundaries

11. Intellectual Property

All content on our website, including text, images, graphics, and logos, is the property of Whispervale and protected by Taiwan and international copyright laws. You may not reproduce, distribute, or use this content without our explicit written permission.

12. Privacy and Data Protection

Your personal information is handled in accordance with our Privacy Policy. By using our services, you consent to the collection, use, and storage of your information as described in that policy. Please review our Privacy Policy for details.

13. Limitation of Liability

To the fullest extent permitted by Taiwan law:

  • Whispervale is not liable for any indirect, incidental, or consequential damages arising from your use of our services
  • Our total liability for any claim related to services shall not exceed the amount you paid for the specific session in question
  • We are not responsible for injuries resulting from failure to disclose health conditions or follow practitioner guidance
  • Individual responses to bodywork vary; we make no guarantees about specific outcomes

14. Indemnification

You agree to indemnify and hold Whispervale, its practitioners, and employees harmless from any claims, damages, or expenses arising from your violation of these Terms or your use of our services, except where such claims result from our negligence or willful misconduct.

15. Termination

We reserve the right to terminate or suspend your access to services at our discretion if:

  • You violate these Terms and Conditions
  • You engage in inappropriate or threatening behavior
  • Your account has repeated no-shows or late cancellations
  • We determine that continuing service would be unsafe or inappropriate

16. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, government actions, public health emergencies, or other force majeure events. In such cases, affected sessions will be rescheduled or refunded.

17. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Taiwan, Republic of China. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Pingtung County, Taiwan.

18. Dispute Resolution

Before initiating formal legal proceedings, we encourage clients to contact us directly to resolve any disputes. Many concerns can be addressed through direct communication. If informal resolution is unsuccessful, disputes may be resolved through mediation before proceeding to litigation.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.

20. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Whispervale regarding the use of our services. They supersede any prior agreements or understandings, whether written or oral.

21. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated "Last Updated" date. Significant changes will be communicated via email to active clients. Your continued use of our services after modifications constitutes acceptance of the updated terms.
